Probate

In Ontario, when someone dies, their trustee often needs to obtain a “Certificate of Appointment of Estate Trustee”. We refer to this process as “going through probate” At Hogarth Hermiston Severs, we have a system for guiding families through the probate process when a loved one dies. Our goal is to make the probate process as simple and stress-free as possible.

Navigating the legalities created by the death of a loved one without a lawyer by your side can be overwhelming and chaotic. Navigating the court processes and forms can feel like reinventing the wheel. Since our lawyers have assisted hundreds of satisfied clients through the probate process over the years, we have the experience necessary to save you from some headaches.

Our lawyers also have the expertise to advise you when something goes awry with an estate. We have experience representing beneficiaries and trustees in court in various types of contested and non-contested matters, including:

  • Applications for the advice and direction of the court in the administration of an estate
  • Passing of estate accounts
  • Removal and replacement of a trustee
  • Motion to prove validity of a will
  • Disputing the validity of a will.

Taking on the role of Estate Trustee can be stressful.

We’re here to help. Book a strategy session with an estate lawyer at either office to get started today.
